This book was a revelation to me. Like virtually all students of the law, I was taught that the primary purpose of the criminal justice system was to adjudicate the guilt or innocence of individual defendants. While this picture was complicated somewhat by the prevalence of guilty pleas, the basic role of the courts was never in doubt. But in this book, Professor Kohler-Hausmann presents a compelling argument that misdemeanor courts in at least some jurisdictions use a very different model of operation, the managerial model:"Under the managerial model, the practical orientation of criminal court actors and their regular operations are largely organized around the supervision and regulation of the population that flows through misdemeanor courts, often with little attention to questions of law and facts in individual cases. The vision of criminal law's social control role in the managerial model is to sort and regulate people over time. The criminal process is deployed to figure out the rule-abiding propensities of people and to calibrate formal regulation appropriately."This theory is backed up by quantitative research about the disposition of misdemeanor cases in New York City and the characteristics of misdemeanor defendants, as well as a qualitative evaluation of the types of tools courts and prosecutors use in individual cases. The author emphasizes the fact that this managerial model is not the result of a preordained political or judicial agenda, but rather the culmination of a series of adaptations that the criminal justice system has made to cope with a flood of misdemeanor cases. The author concludes with a discussion of the costs and benefits of this managerial model, acknowledging its practical benefits while highlighting the way that this model, "like so many others in criminal justice, functions to either reproduce class and racial inequality or manage the effects of class and racial inequality in a punitive fashion."This is a concise, accessible, deeply-researched, and theoretically ground-breaking book that should be considered essential reading for anyone interested in the operation of our criminal justice system.
The content is good, but it is written in a clinical, dissertation way. It is a bit dry. It is clearly well-researched but hard to get through.
Very well written, great use of statistics to show an astonishing change in the way that lower-courts work, and makes the social process of management poverty come alive.
